2018 Opihr World Adventure Cocktail Competition Terms & Conditions

Entrants will be deemed to have accepted these terms and conditions (“Terms and Conditions”), and agreed to be bound by them, when entering this Promotion. The Promoter reserves the right to amend these Terms and Conditions at any time.

PROMOTER

1. The promoter is Quintessential Brands Company, Melbury Park, Clayton Rd, Birchwood, Warrington WA3 6PH (“Promoter”).
2. The Promoter is responsible for all administrative aspects of the Promotion (including determination of winners, prize-giving, and technical support etc.), with the assistance of partners and distributors.

5. Any entries received after the Closing Date in the Entrant’s country of residence will not be considered for inclusion in the Promotion.

CONDITIONS OF ENTRY

6. This competition (“Promotion”) is open to freelance or employed bartenders by bar/restaurant or industry establishments who are residents of Australia, South Africa, Germany, Italy, Greece, Mexico, South East Asia, the Netherlands and the UK.
(“Entrants”). Entrants must be of legal drinking age in their country of residence.
7. The following may not enter or win a prize: (a) employees of Promoter or its agents and their family members and (b) anyone else who is directly or indirectly professionally connected with the Promotion or the Promoter and their family members
8. If at any point in the competition the Promoter becomes aware that an Entrant does not meet the eligibility requirements, The Promoter reserves the right to disqualify that Entrant, and if applicable, re-award the prize to an eligible Entrant.
9. There is no purchase necessary of any promoter products to enter the Promotion
10. By entering the Promotion, the entrant is indicating his/her agreement to be bound by these Terms and Conditions.
11. The promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the competition will be notified to entrants as soon as possible by the promoter.
12. The promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition

HOW TO ENTER

13. To take part in this Promotion Entrants must follow the below instruction:
A. Post an image or video of their cocktail submission on Instagram or competition/opihr.com
B. Include the name of the cocktail & the name of the local ingredient
C. Geotag the city you are from
D. Include #opihrworld
E. Tag @opihrgin in the image

14. The submission must contain a minimum of 25ml of Ophir Gin.
15. The Promoter will contact the entrant within 30 days of receiving the entry via Instagram direct message or email, to confirm whether the information provided is complete and whether the entry has been accepted into the competition.
16. Personal information submitted as part of application to the Promotion outlined in section 14 will be processed in accordance with the EU’s General Data Protection Regulation (GDPR) and applicants from all participating markets will be required to consent to their submitted personal data being processed upon application submission.

LIMITATIONS / RESTRICTIONS ON ENTRY

17. Incomplete entries and entries that do not comply in full with these Terms and Conditions will be rejected.

DRINKS CONTENTS STANDARDS FOR ENTRIES

18. The content standards set out below (“Content Standards”) serve to provide examples and are not meant to be an exhaustive list of the types of Content that are unacceptable for the purposes of the Promotion. “Content” means the name and the method for making the drink and any photography and video footage provided.
19. The Promoter expressly reserves the right to disallow or disqualify (or prevent from passing through the judging stage) any entry which it considers does not comply with these Content Standards or which it considers does not meet normal standards of taste and decency.
20. By entering this Promotion, Entrants confirm that their Content meets the following Content Standards, the Content must not:
21. a) encourage, condone, promote or glamorize excessive or irresponsible consumption of alcoholic beverages, consumption of alcoholic beverages by individuals below legal drinking age or drink driving or any behaviour considered antisocial, illegal or immoral;
22. b) be derogatory or defamatory of any person;
23. c) be obscene, offensive, hateful or inflammatory;
24. d) promote violence of any kind or suggest any association with bravado, aggressive or antisocial behaviour;
25. e) be sexually explicit (or contain any nudity) or suggest any association with sexual activity or sexual success;
26. f) harm or attempt to harm minors in any way;
27. g) be targeted at or be likely to particularly appeal to an audience under the legal drinking age in their country of residence;
28. h) promote discrimination of any kind, including but not limited to discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
29. i) be likely to harass, upset, embarrass alarm or annoy any person;
30. j) be used to impersonate any person, or to misrepresent the entrant’s identity or their affiliation with another person or entity;
31. k) give alcoholic strength or intoxicating effect undue emphasis;
32. l) suggest that consumption of the drink can lead to social success or popularity; and
33. m) suggest the drink has therapeutic qualities or can enhance mental or physical capabilities.

34. By entering the Promotion, Entrants grant the Promoter, its affiliated companies and its sub-contractors an exclusive, transferable, royalty-free right to use any and all content supplied to the Promoter in connection to the Promotion.
35. for the purposes of administering this Promotion;
36. b) for promotional and publicity purposes; and
37. c) in all digital and social media in connection with the Promoter and the Promotion.
38. Entrants hereby agree to do such other things and execute such other documents as are reasonably requested in order to allow the Promoter to make such use of their Content.
39. To the extent permitted by law, Entrants hereby waive in favour of the Promoter and agree not to assert any moral rights (or similar rights worldwide) in and in connection with their Content.
40. Entrants must own or have full and unrestricted permission to use the intellectual property rights (IPRs) in any cocktails or recipes used in connection to the Promotion. In consenting to these Terms and Conditions, you hereby grant to the Promoter, its affiliates and associated parties royalty-free, unrestricted, worldwide, irrevocable, perpetual and fully sub-licensable right to use the IPRs in the Submissions for the purposes of the Promotion and in related promotional material or activity.

APPLICATION SELECTION PROCESS

41. Regional finalists will be selected from the pool of valid entries. 8-10 bartenders from participating countries will be selected to take part in the regional finals. These will be selected by a judging panel administered by Quintessential Brands Group based on creativity, innovation, and original use of Opihr Gin in their cocktails. Personality and brand story will also be a key factor in selection process. Entrants will be notified whether they have been selected for the regional final no later than 30 days after the Closing Date via Instagram direct message or email.
42. Regional Finals: Regional finals will take place in each of the UK, Ireland, Netherlands, Italy, Portugal, Germany, Australia, Hong Kong, South Africa, Mexico, Malaysia, Indonesia, and Vietnam. Entrants from Greece and Cyprus will be invited to participate in one regional final in Greece.
43. Regional finalists will be notified of the date of the regional final when they receive confirmation that they will be eligible to attend that regional final. The winner for each regional final will be decided based upon the following criteria: : (i) Taste & Balance (25%), Creativity & Innovation (25%), Use of Opihr in cocktail (20%), Presentation & appearance (20%), Relevance and appeal of recipe name (10%).
44. Global Final: The winner from each regional final will be invited to the global final, in Istanbul, where one winner will be selected as the winner of the 2018 Opihr World Adventure Cocktail Competition. Regional Final Winners must be able to travel to the Global Final in mid-end September 2018 or their entry in the Global Final will be forfeited and will be awarded to another Entrant. The Promoter will pay the following expenses for each participant in the global final (“Global Final Contestant”) to attend the Global Final: (i) one economy class return air flight to the global final from a major airport near the Global Final Contestant’s residence; (ii) four nights hotel accommodation, (iii) ground transportation to & from the international cocktail competition while on site of the final, and (iv) meals. All other expenses are the Global Final Contestant’s responsibility, including telephone/Internet; room-service charges; gratuities; any airline changes fees where the Global Final Contestant seeks to change their flights, dates of travel or travel details; any additional airline or airport charges including, but not limited to, seat assignments, baggage fees or airport taxes. Each Global Final Contestant is responsible for arranging, and the cost of, travel and from the airport in their country of residence. Each Global Final Contestant is responsible for ensuring they have all necessary visas, travel documentation, travel insurance and inoculations at their own cost. Any penalties associated with changes made to any reservation following confirmation of booking will be the responsibility of the Global Final Contestant. Only costs specifically identified above will be met by the Promoter.

PRIZE

45. The winner of the World Final in Istanbul will be crowned the Spirit of Ophir and will have the opportunity in 2019 to support regional finals to share their experience and knowledge of the competition with fellow bartenders before returning as a judge in 2019’s World Final.
46. The Promoter reserves the right to substitute the prize (or any part thereof) for a prize or prizes of equivalent or greater monetary value if this is necessary for reasons beyond its reasonable control. There is no cash alternative to the prize (or any part thereof)) and unless the Promoter agrees otherwise in writing the prizes are non-refundable and non-transferable

LIABILITY

47. The Promoter accepts full liability for death or personal injury caused by its negligence, or loss caused by a false statement where the statement is made fraudulently, or for any other losses that cannot be excluded at law. Otherwise, the following exclusions of liability will apply. References to the “Promoter” in this Liability section include all of the Promoter’s associated companies, agents or any other third party involved in the Promotion.

48. The Promoter will not be responsible for (and will have no liability in connection with) the following occurrences, to the extent that they occur for reasons beyond the Promoter’s reasonable control:
. a) any postponement or cancellation of the Promotion;
. b) any changes to the prize or the way in which they can be used; or
. c) any travel delays during the prize trip.

49. The Promoter does not accept responsibility for network, computer, hardware or software failures of any kind, which may affect the sending, receipt or processing of your entry or for entries lost, damaged, delayed or unreadable, including loss of entries through technical fault or transmission delays.
50. If the Promoter has grounds to suspect any Entrant or third party of cheating, deception or fraudulent or unsportsmanlike conduct of any kind (including, without limitation, manipulating the Promotion, choice of prize winner(s) or any entry (or establishing multiple registrations in order to gain multiple entries) the Promoter reserves the right (in its sole discretion) to disqualify any Entrant, entry or person it reasonably believes to be responsible for, or associated with, such activity.
51. The winner should be in good health and appropriately fit for travel and waives any claim they may have against the Promoter for any safety or health issue or problem they may have during travel.

PERSONAL DETAILS AND PUBLICITY

52. The Promoter will use each winner’s, and each Entrant’s personal details for the purpose of administering this Promotion. Please note that Entrants’ data may be transferred to, processed and/or stored outside the European Economic Area.
53. By entering this Promotion, Entrants grant the Promoter the free use of their name, country of residence, photographs, video and voice (“Image”) for advertising, publicity and news purposes in any media in connection with the Promotion in perpetuity without additional remuneration. The winner’s acceptance of the prize shall be deemed to be a confirmation of their agreement for the Promoter to use their Image, and the winner shall sign any further documentation reasonably required by the Promoter in this regard. A winner may also be asked to take part in reasonable publicity and PR activity in connection with the Promotion.

PROMOTERS INTELLECTUAL PROPERTY

54. All intellectual property and database rights, and our materials published on them, excluding so-called “user generated content” but including, without limitation, trademarks, designs, logos, text, images, audio and video materials, look and feel and software (including code, interface and website structure) (“Materials”) are owned by the Promoter (or its subsidiaries, affiliates, agents or partners).
55. The Materials are protected by intellectual property laws and treaties around the world.
56. All such rights are reserved and it is strictly prohibited to remove any copyright or other proprietary notices from any Materials.

ENGLISH LAW APPLIES

57. This Promotion, and any dispute or claim arising out of or in connection with it (including the prizes), shall be governed by and construed in accordance with English law and entrants irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
